1. Who you are contracting with

These Terms form an agreement between you and imad ibrahim khalaf khalaf("we", "us", "our"), operating the SkinMatch AI service (the "Service"). By creating an account or using the Service you accept these Terms. If you do not agree, do not use the Service.

2. The Service

SkinMatch AI provides AI-based skin tone and undertone analysis with cosmetic, hair, and outfit color recommendations. New accounts receive 3 free AI analyses. Continued use beyond the free tier requires a paid subscription.

3. Accounts

You must provide accurate information, keep your credentials confidential, and are responsible for activity under your account. You must be of legal age in your jurisdiction.

4. Acceptable use

You agree not to:

• use the Service unlawfully or for fraud, spam, or harassment;
• upload images of other people without their consent, or content that infringes intellectual property or privacy rights;
• upload illegal content, CSAM, hate, or sexually explicit material;
• attempt to reverse engineer, scrape, probe, or interfere with the Service or introduce malware;
• resell or redistribute the Service or its outputs in violation of these Terms.

5. AI outputs

Recommendations are informational suggestions generated by AI and may be inaccurate. They are not medical, dermatological, or professional advice. You are responsible for how you use the outputs. You retain rights to images you upload and grant us a limited license to process them solely to provide the Service.

6. Intellectual property

We retain all rights, title, and interest in the Service, including its software, models, branding, and content. We grant you a limited, non-exclusive, non-transferable right to use the Service for personal purposes under the plan you have selected.

7. Subscriptions, payments, and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Subscription plans renew automatically (monthly at $7 USD or yearly at $55 USD) until you cancel. Pricing, billing frequency, taxes, cancellation, and refund mechanics are governed by Paddle's Checkout Buyer Terms. See also our Refund Policy.

8. Service availability

The Service is provided "as is". We do not guarantee uninterrupted, error-free, or fault-free operation. To the fullest extent permitted by law we disclaim all implied warranties.

9. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may cancel your subscription at any time via the customer portal.

10. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, or loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited by law.

11. Changes

We may update these Terms. Continued use after changes take effect constitutes acceptance.
